The High Court has been told News Ltd never specifically targeted the South SydneyRabbitohs for exclusion from its 14-team National Rugby League competition in 2000.

News Ltd is appealing against a decision by the full bench of the federal court a yearago that reinstated Souths into the NRL this year.

Souths argued that an agreement between the NRL and the Australian Rugby League wasa breach of the Trade Practices Act because it restricted to 14 the number of teams eligibleto play in 2000.

News Ltd counsel ANTHONY MEAGHER has argued that placing a limit on the number of clubswhich could play meant one or more clubs would be excluded.

But he's told the court the legal significance only arises if those excluded were intendedto be excluded.

Mr MEAGHER says none of the 20 clubs seeking admission in the NRL competition had anautomatic right to be included.

Meanwhile, the court has granted the Australian Competition and Consumer Commissionleave to appear in the case so it can make submissions on the interpretation and applicationof competition law.
